General terms and conditions Villa Palm Crest Curaçao

The agreement, and therefore the acceptance of these general terms and conditions, is concluded by acceptance of the offer from Villa Palm Crest by the tenant.
The main tenant must be at least 25 years old and must also stay in the villa.
After the agreement has been concluded, we ask for the passport numbers of all guests, after which the main tenant will receive the rental agreement by e-mail for signature and the invoice for the down payment.
Approximately six weeks before arrival you will receive information from our guests by email, which will include our house rules.
These general terms and conditions of Villa Palm Crest can be found on the website at all times www.villapalmcrestcuracao.com.
- A down payment of 40% of the total agreed rental sum must be paid when agreeing. Once we have received this payment, the reservation is confirmed.
- The remainder of the rental amount must be received by Villa Palm Crest no later than six weeks before arrival. If payment is not made on time, the tenant is in default and Villa Palm Crest will notify this by e-mail. The tenant will then still have the option to pay the amount due within 7 days. If payment is still not made, the agreement will be deemed to have been canceled. Villa Palm Crest has the right to charge the cancellation costs of €75.00.
- If the agreement is concluded within six weeks before arrival, the entire rental sum must be paid immediately.
The rental amount is announced upon conclusion of the rental agreement and consists of:
- The rental of Villa Palm Crest
- Tourist tax of 7%
- Final cleaning €190.00
Electricity consumption is included up to 40 Kwh per night and water up to 4 m3 per week, extra consumption will be deducted from the deposit and amounts to €0.55 per Kwh for electricity and €10.00 per m3 for water.
The meter readings are taken by the manager at the beginning and end of your stay.
The tenant is obliged to pay a deposit of €500.00 in advance via the bank stated on the invoice.
At the end of the rental period, Villa Palm Crest will pay this deposit back within 1 week, after deducting what the tenant owes to the landlord, such as costs for extra consumption of electricity, water, damage, etc.
The tenant can occupy the villa from 4 p.m. on the agreed day of arrival, unless otherwise agreed in writing. You will receive the keys and information from our manager upon arrival. The villa will be inspected with you upon arrival and departure for use, damage and inventory. The electricity and water levels are also recorded in your presence.
The tenant must vacate the villa before 12 noon on the agreed day of departure, unless otherwise agreed in writing. A late check-out is often possible.
The tenant must return the keys and associated items to the manager and, if necessary, to report damage and/or defects. If damage and/or missing items are not reported to the manager, Villa Palm Crest can hold the tenant responsible for causing damage, which can be deducted from the deposit.
The tenant can be held liable for theft of and damage to the contents if the theft occurs without traces of forced entry, for example by not closing windows and/or doors during absence or not activating the alarm.
The landlord is not liable for:
- Theft, loss or damage of any kind during or as a result of a stay at Villa Palm Crest.
- The breakdown or decommissioning of technical equipment, temporary failure or disruptions in and around the home of water and/or energy.
- Nuisance from activities outside the rented plot.
- Failure to execute or partially execute the rental agreement in the event of force majeure
- Damage due to (natural) disasters
- Accidents in and around the swimming pool and in and around the house
We recommend taking out good travel and cancellation insurance with worldwide coverage.
The villa and contents are insured against the usual risks and according to the usual conditions with a local insurance company. Renter's goods are not insured under this policy.
If an agreement is canceled by the tenant, the tenant owes the following cancellation costs:
- In case of cancellation within 30 days before arrival: 100% of the rental amount
- In case of cancellation up to 30 days before arrival: 50% of the rental amount
If Villa Palm Crest is forced to cancel an agreement due to serious circumstances, the full (paid) rent will be refunded to the tenant.
Major circumstances are understood to mean circumstances that are of such a nature that further commitment from Villa Palm Crest cannot reasonably be required. Examples of this are; natural disasters, strikes, storm or water damage, burglary or robbery, construction activities in the area, war (threats), home that can no longer be rented (e.g. due to fire), etc.
Owner is obliged to make the rented property available to the tenant in good condition and clean on the agreed date and time.
Tenant is obliged to use the rented property properly and to leave the rented property in good condition, neat and tidy. Tidy is meant to be garbage-free, the dishes must be left in the dishwasher and/or clean. The BBQ must also be left clean after use. The landlord is allowed to deduct any additional cleaning costs from the deposit.
It is not permitted to transfer rights or sublet the property to third parties.
Villa Palm Crest is managed by an administrator, who handles check-in and check-out and is available at all times during the stay. The villa needs to be cleaned regularly, the garden and swimming pool also need to be maintained and sometimes urgent repairs are needed. As a result, staff will have to enter the villa or garden on behalf of the manager of Villa Palm Crest. You will be informed about this in advance, so that you know when to expect this. We hope for your understanding for this.
Any printing errors in these general terms and conditions, on our website or other forms and documents are subject to change.
The landlord reserves the right to make interim changes.
Under no circumstances is the lessor liable and responsible for any damage caused to all persons involved or to movable and immovable property.
The tenant hereby waives any recourse against the landlord, the owner of Villa Palm Crest. This rental agreement is exclusively governed by Dutch law. All disputes arising from the rental agreement will be handled by the court in the Netherlands.
